General terms and conditions of sale

PREAMBLE

  1. The present conditions apply to all reservations made with the company LE BELVEDERE DE KERGROADEZ operating the hotel restaurant LE BELVEDERE in Brest. They cannot be opposed for all reservations made through a reseller of the company LE BELVEDERE DE KERGROADEZ (ex Booking.com, Expédia, Loisirs Enchères, Groupon, …).
  2. For all reservations made through a reseller of the company LE BELVEDERE DE KERGROADEZ, please refer to the General Terms and Conditions of Sale of the reseller.
  3. The customer declares that he/she has full legal capacity to enter into these terms and conditions.
  4. The customer’s agreement to the general terms and conditions of sale and to the terms and conditions of sale of the reserved rate is obtained at the time of reservation; no reservation is possible without this agreement.
  5. The customer may save and edit these terms and conditions using the standard functions of his browser or computer.

I. RESERVATION

  1. Prices quoted remain firm until the date of the option.
  2. Reservations only become definitive on receipt of the deposit paid for the service.
    The amount of the deposit varies according to the service offered.
  3. Reservations cannot be taken into account without payment of a deposit or communication of the unique code of a gift voucher.
  4. Reservations cannot be taken into account without a credit card number and its validity date (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram.
  5. Reservations cannot be taken into account without a valid e-mail address.
    The latter is used to communicate booking details and the General Sales Conditions relating to the booking.

II. RATES

  1. Prices are quoted in Euros. VAT is always included. The prices indicated include only the services strictly mentioned in the reservation. Any additional services provided by the hotelier during the stay and, where applicable, tourist tax, will be added to the price mentioned in the reservation at the time of invoicing.
  2. The prices applicable are those in force on the day of booking. As independent professionals, hoteliers are free to change their prices at any time. Therefore, the price displayed during a visit to our website is only valid for orders taken during the period in which it is displayed. Only the price indicated in the booking confirmation is binding.
  3. ‘’Best rate guaranteed” – After reserving a room on castelach.fr, and within a maximum of 24 hours, the price difference may be reimbursed if the rate recorded by another e-distributor (e.g. Booking, Hotels.com, Expedia, Trivago, etc.), for the same date and strictly identical stay conditions (same room, same duration, same options, same cancellation conditions, etc.) is lower. It is the customer’s responsibility to provide proof of this lower rate. If the rate applied on the castelach.fr website is the same or lower, no refund will be made.

III. BOOKING CONDITIONS

A. General terms and conditions

  1. Your credit card number and its validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  2. As a deposit, 30% of the total amount of the stay indicated at the time of booking may be debited from the credit card provided at the time of booking, depending on the booking conditions for the chosen rate.
  3. A bank authorization request may be made on your credit card. The amount may not exceed the amount shown on your confirmation. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the ceiling of the credit card used to guarantee the possibility of a future debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.

B.Special offers

  1. At the time of booking, you will be asked to provide your credit card number and expiry date (please note that the credit card used must be valid at the time of booking), as well as the visual cryptogram.
  2. The total cost of the accommodation indicated at the time of booking will be debited from the credit card provided at the time of booking. Tourist taxes are not included.

C. Special case of package holidays

  1. You will be asked for your credit card number and validity date (please note that the credit card used must be valid at the time of booking), as well as the visual cryptogram at the time of booking.

D. Special case of “gift voucher” bookings.

  1. Holders of a gift voucher must communicate the unique code shown on their gift voucher at the time of booking.
  2. The services ordered by means of a card will be those mentioned on the gift voucher.
  3. Your credit card number and its validity date (it is specified that the credit card used must be valid at the time of the stay) and the visual cryptogram will be requested at the time of booking.
  4. In the event of booking with a valuable gift voucher, and if the value of this gift voucher is not fully used during the stay, the customer will not be entitled to a refund of the balance. The balance remains valid for future services until the end of the gift voucher’s validity.

E. Special case of “gift voucher” bookings

  1. Gift voucher holders must communicate the unique code shown on their gift voucher at the time of booking.
  2. You will be asked for your credit card number and validity date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram at the time of booking.
  3. If the value of the gift voucher is not used up during the stay, the customer will not be entitled to a refund of the balance. The remainder remains valid for future services until the end of the gift voucher’s validity.

IV. CANCELLATION AND MODIFICATION CONDITIONS

A. General conditions

  1. For accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be provided on a specific date or for a specific period.
  2. In the event of a request to modify the dates of stay, or the type or quality of the service, prices may be revised upwards. The deposit will be transferred to the new reservation. In the event of an increase in the initial price, an additional deposit will be debited, up to a maximum of 30% of the estimated total cost of the service. Any request for modification must be made in writing (e-mail or post). Any modification is deemed valid only after written agreement from the establishment.
  3. Regardless of the cancellation period, deposits are non-refundable.
  4. All requests for cancellation must be made in writing (e-mail or post). The date of the request (date of e-mail or postmark) will be used to calculate the cancellation period.
  5. You can cancel your reservation up to 7 days before arrival. After this date, the first night will be charged to your credit card. Any deposit paid will not be deducted from this amount.
  6. In the event of a no-show, the total cost of the accommodation will be charged to the credit card provided at the time of booking, less any deposit paid.
  7. The modification or cancellation of a service booking can be made directly with the establishment, whose contact details, including telephone number, are specified on the booking confirmation sent by e-mail.
  8. In the event of interruption of the service by the customer (e.g. early departure), the full amount of the agreed price will be charged.
  9. Cancellation of a reservation for a service booked online can be made directly on the site via the “Consult or cancel your reservation” section of the online reservation platform.

B.Special offers

  1. In the case of accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to accommodation services to be provided on a specific date or for a specific period.
  2. Whatever the cancellation period, any sums paid are non-refundable.
  3. In the event of interruption of the service due to the customer’s fault (e.g. early departure), and in the case of reservations with prepayment before the stay, no refund will be granted.

C. Special case of package holidays

  1. In the case of accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to accommodation services to be provided on a specific date or for a specific period.
  2. Whatever the cancellation period, deposits are non-refundable.
  3. You may cancel your booking up to 7 days before arrival. After this date, the total cost of your stay will be charged to your credit card, less any deposit paid.
  4. In the event of a no-show, the full amount of the stay will be charged to the card provided at the time of booking, less the deposit paid.
  5. In the event of interruption of service due to customer fault (e.g. early departure), the full amount of the agreed price will be charged.

D. Special case of “gift voucher” bookings.

  1. In the case of accommodation services (reservation of rooms in an establishment or other types of accommodation), customers are reminded that they do not have the right of withdrawal provided for in article L. 221-18 of the French Consumer Code, and this in accordance with article L. 221-28 paragraph 12 of the French Consumer Code, which excludes this right for contracts relating to the provision of accommodation services which must be supplied on a specific date or for a specific period.
  2. You can cancel your reservation up to 7 days before your arrival. The gift voucher will then remain valid until its expiry date. After this period, the gift voucher is forfeited to the hotel, and any additional services or the balance of the stay will be charged to the credit card provided at the time of booking.
  3. In the event of no-show, the gift voucher is forfeited to the hotel and any additional services or the balance of the stay billed to the credit card provided at the time of booking.
  4. If the service is interrupted due to the customer’s fault (e.g. early departure), the gift voucher will be forfeited by the hotel and any additional services or the balance of the stay will be charged to the credit card provided at the time of booking.

F. In case of force majeure

  1. Force majeur is defined as any unforeseeable and insurmountable event outside the control of the parties, which prevents either the customer or the hotelier from fulfilling all or part of their obligations under the contract. This is particularly the case in the event of strike, insurrection, riot, or prohibitions issued by government or public authorities.
  2. It is expressly agreed that force majeure suspends the parties’ performance of their mutual obligations, and that each party shall bear the costs arising therefrom. In particular, customers alone will bear any additional costs that may be incurred to enable the tour to continue, following the occurrence of a case of force majeure.
  3. Any deposit paid at the time of booking will be retained and may be used for a new service within a maximum period of 18 months.
  4. In the event of force majeur or any other exceptional event which prevents the Service from being carried out, and in particular prevents the reserved room in the establishment from being made available to the Customer, the establishment may reserve the right to accommodate the Customer, in whole or in part, in an establishment of equivalent category, or to carry out a Service of the same nature, subject to the prior agreement of the Customer.

V. RESTAURANT

  1. Reservations for the restaurant can be made by telephone, e-mail or via the online reservation module on the belvédèrehotel-brest.fr website.
  2. Your credit card number and expiry date (please note that the credit card used must be valid at the time of booking) and the visual cryptogram will be requested at the time of booking.
  3. A bank authorization request may be made on your credit card. The fee for this authorization request is €30.00 per item. The authorization request is not an immediate debit, but corresponds to a reserve for future payment, authorized by the customer’s bank, which temporarily reduces the credit card limit used to guarantee the possibility of a future debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.
  4. The number of place settings must be specified at least 24 hours before the arrival of the participants.
  5. In the event of a downward change in the number of place settings 24 hours before the arrival of the participants, the establishment reserves the right to debit the flat-rate amount of €20.00 per place setting cancelled.
  6. In the event of a no-show, the establishment reserves the right to debit the flat-rate amount of 30.00€ for each place setting cancelled.

VI. PETS

Pets are allowed in the hotel (with an extra charge of €12.00 per night) provided they are kept on a leash in and around the premises. They are not allowed in the restaurant areas.

VII. STAY& ROOMS

  1. In application of the regulations in force in certain countries, the customer may be asked to complete a police form on arrival at the hotel. To do so, the customer will be asked to show proof of identity in order to verify whether or not he/she is required to complete the police form.
  2. The customer accepts and undertakes to use the room in good manners. Any behavior contrary to good morals and public order will lead the hotelier to ask the customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.
  3. Rooms are available from 3:00 p.m. on the day of arrival and must be vacated by 11:00 a.m. on the day of departure.
  4. The entire establishment is non-smoking. Guests are asked to respect this rule, particularly in the rooms. In the event of non-compliance with this rule, a flat-rate charge of €300.00 will be debited from the credit card provided at the time of booking.
  5. In the event of damage to furniture or theft, the hotel reserves the right to debit a flat-rate amount of €500.00 from the credit card provided at the time of booking.
  6. The hotel offers WIFI access for guests to connect to the Internet. The customer undertakes to ensure that the computer resources made available by the hotel will not be used in any way for the purpose of reproducing, representing, making available or communicating to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorization is required. Should the customer fail to comply with the aforementioned obligations, he or she risks being accused of counterfeiting (article L.335-3 of the French Intellectual Property Code), punishable by a fine of 300,000 euros and three years’ imprisonment. The customer is also required to comply with the security policy of the hotel’s Internet service provider, including the rules governing the use of security measures implemented to prevent the unlawful use of IT resources, and to refrain from any action that might undermine the effectiveness of these measures.

VIII. RESERVED ACCESS

Access to certain parts of the building may be restricted. Information is available at reception.

IX. MOOVE

In the event of an exceptional event or the impossibility of making the reserved room available to the customer, or in the event of force majeure, the establishment reserves the right to accommodate the customer in whole or in part in a hotel of equivalent category, for services of the same nature and subject to the customer’s prior agreement. Any additional cost of the room, transport between the two hotels and a telephone call will be borne by the establishment.

X. RETURN OF FORGOTTEN PERSONAL EFFECTS

Personal effects will be sent via our partner L’Host. If personal effects are forgotten, the customer will be informed by e-mail of the possible return details and will process the return with our partner L’Host.

XI. COMPLAINTS

Complaints relating to the non-performance or poor performance of hotel services must, in order to facilitate their processing, be brought to the attention of LE BELVEDERE DE KERGROADEZ in writing within eight days of the date of departure from the hotel, either directly to the hotel or to the Customer Service contact details given below. In the absence of a satisfactory response, or in the absence of a response within 60 days, the customer may refer the matter free of charge to the Tourism and Travel Ombudsman, whose contact details and procedures are available on his website: www.mtv.travel
